css=\u201d\u201d]<\/p>\n<blockquote><p>La <strong><a href=\"https:\/\/www.mapa.gob.es\/dam\/mapa\/contenido\/alimentacion\/participacion-publica\/sgcsa\/eiple_reglamento_ue_2018_848_ecologico\/propuesta-de-reglamento.pdf\">Proposition de r\u00e8glement COM(2025) 780 final<\/a><\/strong> porte, entre autres aspects, sur les questions relatives au <strong>r\u00e9gime d\u2019\u00e9tiquetage des produits biologiques import\u00e9s.<\/strong> La proposition visant \u00e0 actualiser le <strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/PDF\/?uri=CELEX:02018R0848-20250325\">R\u00e8glement (UE) 2018\/848 sur la production et l\u2019\u00e9tiquetage des produits biologiques<\/a><\/strong> traite des aspects li\u00e9s \u00e0 la production, \u00e0 la certification et au contr\u00f4le, en consacrant la majeure partie des modifications \u00e0 l\u2019\u00e9tiquetage, notamment en ce qui concerne l\u2019utilisation du <strong>logo biologique de l\u2019Union europ\u00e9enne<\/strong> et des <strong>termes \u00ab eco \u00bb, \u00ab bio \u00bb ou \u00ab organic \u00bb<\/strong>.<\/p><\/blockquote>\n<p>Il s\u2019agit d\u2019une proposition qui r\u00e9pond \u00e0 la fois \u00e0 la <strong>jurisprudence r\u00e9cente de la Cour de justice de l\u2019Union europ\u00e9enne (CJUE)<\/strong> et \u00e0 la n\u00e9cessit\u00e9 de <strong>renforcer la confiance des consommateurs<\/strong>, de garantir une <strong>concurrence loyale<\/strong> et d\u2019\u00e9viter des perturbations dans le commerce international des produits biologiques.<\/p>\n<p><strong>L\u2019<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/PDF\/?uri=CELEX:62023CJ0240\">arr\u00eat C-240\/23 (Herbaria Kr\u00e4uterparadies II)<\/a><\/strong> constitue le d\u00e9clencheur juridique de cette r\u00e9forme, puisqu\u2019il a conclu que, selon la r\u00e9daction actuelle du r\u00e8glement (UE) 2018\/848, <strong>les produits import\u00e9s sous le r\u00e9gime d\u2019\u00e9quivalence ne peuvent ni utiliser le logo biologique de l\u2019UE ni, en principe, les termes faisant r\u00e9f\u00e9rence \u00e0 la production biologique<\/strong>.<\/p>\n<p>Cette interpr\u00e9tation stricte a g\u00e9n\u00e9r\u00e9 une <strong>ins\u00e9curit\u00e9 juridique significative<\/strong>, tant pour les op\u00e9rateurs que pour les autorit\u00e9s comp\u00e9tentes, et a mis en \u00e9vidence le risque de:<\/p>\n<ul>\n<li>confusion des consommateurs,<\/li>\n<li>distorsion de la concurrence entre les produits biologiques de l\u2019UE et ceux des pays tiers,<\/li>\n<li>et blocages commerciaux, notamment compte tenu du fait que de nombreux syst\u00e8mes de production reconnus comme \u00e9quivalents <strong>exigent l\u00e9galement l\u2019utilisation de termes biologiques<\/strong> sur l\u2019\u00e9tiquetage.<\/li>\n<\/ul>\n<p>En ce qui concerne l\u2019<strong>utilisation des termes biologiques<\/strong>, la proposition clarifiera <strong>l\u2019article 30 du r\u00e8glement (UE) 2018\/848<\/strong> afin d\u2019\u00e9tablir d\u00e9finitivement quand les termes \u00ab eco \u00bb, \u00ab bio \u00bb, \u00ab organic \u00bb et leurs d\u00e9riv\u00e9s peuvent \u00eatre utilis\u00e9s.<\/p>\n<p>\u00c0 la suite de cette modification:<\/p>\n<ul>\n<li><strong>L\u2019utilisation de termes faisant r\u00e9f\u00e9rence \u00e0 la production biologique est express\u00e9ment autoris\u00e9e<\/strong> pour:\n<ul>\n<li>les produits qui <strong>respectent pleinement<\/strong> le r\u00e8glement (UE) 2018\/848;<\/li>\n<li>les produits <strong>import\u00e9s de pays tiers<\/strong> dont le syst\u00e8me de production et de contr\u00f4le a \u00e9t\u00e9 reconnu comme <strong>\u00e9quivalent<\/strong>, conform\u00e9ment \u00e0 l\u2019article 45.1.b (ii) et (iii).<\/li>\n<\/ul>\n<\/li>\n<li>L\u2019interdiction d\u2019utiliser ces termes est maintenue pour les produits qui ne respectent aucun de ces r\u00e9gimes.<\/li>\n<\/ul>\n<p>La proposition facilitera la connexion entre la l\u00e9gislation de l\u2019UE et <strong>les <a href=\"https:\/\/www.fao.org\/fileadmin\/user_upload\/livestockgov\/documents\/cxg_032f.pdf\">directives du Codex Alimentarius (CAC\/GL 32\/1999) relatives aux aliments produits biologiquement<\/a><\/strong> et les r\u00e9glementations nationales des pays tiers, \u00e9vitant que des produits l\u00e9galement \u00ab biologiques \u00bb \u00e0 l\u2019origine soient priv\u00e9s de toute r\u00e9f\u00e9rence \u00e0 leur m\u00e9thode de production sur le march\u00e9 de l\u2019UE.<\/p>\n<p><strong>Red\u00e9finition de l\u2019utilisation du logo biologique de l\u2019Union europ\u00e9enne.<\/strong> L\u2019\u00e9l\u00e9ment central de la proposition r\u00e9side dans le <strong>remplacement int\u00e9gral de l\u2019article 33<\/strong>, red\u00e9finissant ainsi le r\u00f4le du <strong>logo biologique de l\u2019UE (la \u00ab Eurofeuille \u00bb)<\/strong>.<\/p>\n<p><strong>Un syst\u00e8me \u00e9chelonn\u00e9 d\u2019utilisation du logo.<\/strong> Il est propos\u00e9 que le logo de l\u2019UE cesse d\u2019\u00eatre un symbole g\u00e9n\u00e9rique d\u2019\u00e9quivalence et fonctionne d\u00e9sormais comme un <strong>sceau d\u2019alignement sur les standards structurels du mod\u00e8le biologique de l\u2019UE<\/strong>.<\/p>\n<p>Il pourra \u00eatre utilis\u00e9:<\/p>\n<ol>\n<li><strong>Sans restrictions<\/strong>, sur les produits biologiques produits dans l\u2019UE conform\u00e9ment aux chapitres II, III et IV du r\u00e8glement.<\/li>\n<li><strong>Produits import\u00e9s sous \u00e9quivalence<\/strong>, <strong>uniquement si<\/strong> ils respectent \u00e9galement <strong>des exigences suppl\u00e9mentaires de production et de contr\u00f4le<\/strong>, pr\u00e9vues dans la nouvelle <strong>annexe VII<\/strong>.<\/li>\n<li><strong>Produits transform\u00e9s dans l\u2019UE<\/strong> incorporant des ingr\u00e9dients \u00e9quivalents:\n<ul>\n<li>lorsque ceux-ci repr\u00e9sentent <strong>\u2264 5 %<\/strong> des ingr\u00e9dients agricoles, ou<\/li>\n<li>lorsqu\u2019ils d\u00e9passent 5 %, \u00e0 condition que ces ingr\u00e9dients respectent les exigences suppl\u00e9mentaires de l\u2019annexe VII.<\/li>\n<\/ul>\n<\/li>\n<li>\u00c0 des fins \u00e9ducatives ou informatives, pour autant que cela ne soit pas trompeur.<\/li>\n<\/ol>\n<p>Il ne pourra pas \u00eatre utilis\u00e9:<\/p>\n<ul>\n<li>sur les produits \u00ab en conversion \u00bb;<\/li>\n<li>sur certains aliments transform\u00e9s d\u00e9finis \u00e0 l\u2019article 30.5;<\/li>\n<li>sur des produits de l\u2019UE contenant plus de 5 % d\u2019ingr\u00e9dients \u00e9quivalents qui <strong>ne<\/strong> respectent pas les exigences suppl\u00e9mentaires.<\/li>\n<\/ul>\n<p>La proposition introduit une <strong>nouvelle annexe VII<\/strong>, qui d\u00e9finit une liste ferm\u00e9e d\u2019exigences techniques du r\u00e8glement (UE) 2018\/848 que les produits import\u00e9s devront respecter pour pouvoir utiliser le logo de l\u2019UE. Ces exigences sont associ\u00e9es aux <strong>\u00e9l\u00e9ments structurels du mod\u00e8le biologique de l\u2019UE<\/strong>, notamment:<\/p>\n<ul>\n<li>des syst\u00e8mes de production v\u00e9g\u00e9tale fond\u00e9s sur le concept de <strong>sol vivant<\/strong>;<\/li>\n<li>des normes renforc\u00e9es de <strong>bien-\u00eatre animal<\/strong>;<\/li>\n<li>des m\u00e9thodes de transformation avec un <strong>usage minimal d\u2019intrants artificiels<\/strong>.<\/li>\n<\/ul>\n<h2><strong>Utilisation obligatoire du logo sur les denr\u00e9es biologiques pr\u00e9emball\u00e9es produites dans l\u2019UE<\/strong><\/h2>\n<p>Une modification pertinente est \u00e9galement introduite \u00e0 l\u2019<strong>article 32<\/strong>, concernant le caract\u00e8re obligatoire du logo sur les denr\u00e9es biologiques pr\u00e9emball\u00e9es produites dans l\u2019UE.<\/p>\n<p>Le logo <strong>ne sera pas obligatoire<\/strong> lorsque:<\/p>\n<ul>\n<li>le produit contient plus de <strong>5 % d\u2019ingr\u00e9dients agricoles import\u00e9s sous \u00e9quivalence<\/strong>, et<\/li>\n<li>ces ingr\u00e9dients <strong>ne respectent pas<\/strong> les exigences de la nouvelle annexe VII.<\/li>\n<\/ul>\n<p>Cette exception \u00e9vite des incoh\u00e9rences r\u00e9glementaires et prot\u00e8ge la valeur du logo de l\u2019UE en tant qu\u2019indicateur de conformit\u00e9 renforc\u00e9e.<\/p>\n<p>Un autre \u00e9l\u00e9ment pr\u00e9vu est la prolongation de la p\u00e9riode de reconnaissance de l\u2019\u00e9quivalence pour les pays tiers. Bien qu\u2019il ne s\u2019agisse pas strictement d\u2019une question d\u2019\u00e9tiquetage, la proposition prolonge jusqu\u2019au <strong>31 d\u00e9cembre 2036<\/strong> la reconnaissance des pays tiers actuellement consid\u00e9r\u00e9s comme \u00e9quivalents.<\/p>\n<p>En <strong>conclusion<\/strong>, il convient de souligner que la proposition de modification du r\u00e8glement (UE) 2018\/848 introduit un <strong>changement conceptuel profond dans l\u2019\u00e9tiquetage biologique<\/strong>:<\/p>\n<ul>\n<li>les <strong>termes \u00ab eco\/bio \u00bb<\/strong> sont associ\u00e9s \u00e0 l\u2019<strong>\u00e9quivalence technique<\/strong>;<\/li>\n<li>le <strong>logo biologique de l\u2019UE<\/strong> est r\u00e9serv\u00e9 aux produits qui respectent \u2014ou s\u2019alignent de mani\u00e8re renforc\u00e9e\u2014 sur le <strong>mod\u00e8le europ\u00e9en de production biologique<\/strong>.<\/li>\n<\/ul>\n<p>Par cette approche, la Commission cherche \u00e0 <strong>prot\u00e9ger la confiance des consommateurs<\/strong>, \u00e0 apporter une <strong>s\u00e9curit\u00e9 juridique<\/strong> au syst\u00e8me et \u00e0 pr\u00e9server la valeur ajout\u00e9e du label biologique europ\u00e9en, sans renoncer \u00e0 un commerce international fluide.<br>\n[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n<\/div><\/body><\/html>","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column][vc_column_text css=\u201d\u201d] La Proposition de r\u00e8glement COM(2025) 780 final porte, entre autres aspects, sur les questions relatives au r\u00e9gime d\u2019\u00e9tiquetage des produits biologiques import\u00e9s.
