href=\"https:\/\/www.mapa.gob.es\/dam\/mapa\/contenido\/alimentacion\/participacion-publica\/sgcsa\/eiple_reglamento_ue_2018_848_ecologico\/propuesta-de-reglamento.pdf\">Proposal for a Regulation COM(2025) 780 final<\/a><\/strong> focuses, among other aspects, on issues relating to the <strong>labelling regime for imported organic products.<\/strong> The proposal to update <strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:02018R0848-20250325\">Regulation (EU) 2018\/848 on the production and labelling of organic products<\/a><\/strong> addresses aspects related to production, certification and control, devoting most of the changes to labelling, especially with regard to the use of the <strong>European Union organic logo<\/strong> and the <strong>terms \u201ceco\u201d, \u201cbio\u201d or \u201corganic\u201d<\/strong>.<\/p><\/blockquote>\n<p>This is a proposal that responds both to the <strong>recent case law of the Court of Justice of the European Union (CJEU)<\/strong> and to the need to <strong>strengthen consumer confidence<\/strong>, ensure <strong>fair competition<\/strong> and avoid disruptions in the international trade of organic products.<\/p>\n<p><strong>The <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:62023CJ0240\">judgment C-240\/23 (Herbaria Kr\u00e4uterparadies II)<\/a><\/strong> is the legal trigger for this reform, as it concluded that, under the current wording of Regulation (EU) 2018\/848, <strong>products imported under the equivalence regime may neither use the EU organic logo nor, in principle, the terms referring to organic production<\/strong>.<\/p>\n<p>This strict interpretation generated <strong>significant legal uncertainty<\/strong>, both for operators and for competent authorities, and highlighted the risk of:<\/p>\n<ul>\n<li>consumer confusion,<\/li>\n<li>distortion of competition between EU organic products and those from third countries,<\/li>\n<li>and trade blockages, especially considering that many production systems recognised as equivalent <strong>legally require the use of organic terms<\/strong> on labelling.<\/li>\n<\/ul>\n<p>With regard to the <strong>use of organic terms<\/strong>, the proposal will clarify <strong>Article 30 of Regulation (EU) 2018\/848<\/strong> to definitively establish when the terms \u201ceco\u201d, \u201cbio\u201d, \u201corganic\u201d and their derivatives may be used.<\/p>\n<p>Following this amendment:<\/p>\n<ul>\n<li><strong>The use of terms referring to organic production is expressly authorised<\/strong> for:\n<ul>\n<li>products that <strong>fully comply<\/strong> with Regulation (EU) 2018\/848;<\/li>\n<li>products <strong>imported from third countries<\/strong> whose production and control system has been recognised as <strong>equivalent<\/strong>, in accordance with Article 45.1.b (ii) and (iii).<\/li>\n<\/ul>\n<\/li>\n<li>The prohibition on the use of such terms is maintained for products that do not comply with either of these regimes.<\/li>\n<\/ul>\n<p>The proposal will facilitate the connection between EU legislation and <strong>the <a href=\"https:\/\/food.ec.europa.eu\/horizontal-topics\/international-affairs\/international-standards\/codex-alimentarius\/codex-alimentarius-commission_en\">Codex Alimentarius guidelines (CAC\/GL 32\/1999) for organically produced foods<\/a><\/strong> with the national regulations of third countries, preventing products that are legally \u201corganic\u201d at origin from being deprived of any reference to their production method on the EU market.<\/p>\n<p><strong>Redefinition of the use of the European Union organic logo.<\/strong> The core element of the proposal lies in the <strong>complete replacement of Article 33<\/strong>, thereby redefining the role of the <strong>EU organic logo (the \u201cEuroleaf\u201d)<\/strong>.<\/p>\n<p><strong>A tiered system for the use of the logo.<\/strong> It is proposed that the EU logo should cease to be a generic symbol of equivalence and instead function as a <strong>seal of alignment with the structural standards of the EU organic model<\/strong>.<\/p>\n<p>It may be used:<\/p>\n<ol>\n<li><strong>Without restrictions<\/strong>, on organic products produced in the EU in accordance with Chapters II, III and IV of the Regulation.<\/li>\n<li><strong>Products imported under equivalence<\/strong>, <strong>only if<\/strong> they also meet <strong>additional production and control requirements<\/strong>, set out in the new <strong>Annex VII<\/strong>.<\/li>\n<li><strong>Products processed in the EU<\/strong> that incorporate equivalent ingredients:\n<ul>\n<li>where these represent <strong>\u2264 5%<\/strong> of the agricultural ingredients, or<\/li>\n<li>where they exceed 5%, provided that those ingredients meet the additional requirements of Annex VII.<\/li>\n<\/ul>\n<\/li>\n<li>For educational or informational purposes, provided that it is not misleading.<\/li>\n<\/ol>\n<p>It may not be used:<\/p>\n<ul>\n<li>on \u201cin conversion\u201d products;<\/li>\n<li>on certain processed foods defined in Article 30.5;<\/li>\n<li>on EU products with more than 5% equivalent ingredients that <strong>do not<\/strong> meet the additional requirements.<\/li>\n<\/ul>\n<p>The proposal introduces a <strong>new Annex VII<\/strong>, which defines a closed list of technical requirements of Regulation (EU) 2018\/848 that imported products must meet in order to use the EU logo. These requirements are associated with the <strong>structural elements of the EU organic model<\/strong>, including:<\/p>\n<ul>\n<li>plant production systems based on the concept of <strong>living soil<\/strong>;<\/li>\n<li>enhanced <strong>animal welfare<\/strong> standards;<\/li>\n<li>processing methods with <strong>minimal use of artificial inputs<\/strong>.<\/li>\n<\/ul>\n<h2><strong>Mandatory use of the logo on packaged organic foods produced in the EU<\/strong><\/h2>\n<p>A relevant amendment is also introduced in <strong>Article 32<\/strong>, concerning the mandatory use of the logo on packaged organic foods produced in the EU.<\/p>\n<p>The logo <strong>will not be mandatory<\/strong> where:<\/p>\n<ul>\n<li>the product contains more than <strong>5% of agricultural ingredients imported under equivalence<\/strong>, and<\/li>\n<li>those ingredients <strong>do not meet<\/strong> the requirements of the new Annex VII.<\/li>\n<\/ul>\n<p>This exception avoids regulatory inconsistencies and protects the value of the EU logo as an indicator of enhanced compliance.<\/p>\n<p>Another element provided for is the extension of the recognition period of equivalence for third countries. Although not strictly a labelling issue, the proposal extends until <strong>31 December 2036<\/strong> the recognition of third countries currently considered equivalent.<\/p>\n<p>In <strong>conclusion<\/strong>, it may be highlighted that the proposal to amend Regulation (EU) 2018\/848 introduces a <strong>profound conceptual change in organic labelling<\/strong>:<\/p>\n<ul>\n<li>the <strong>terms \u201ceco\/bio\u201d<\/strong> are associated with <strong>technical equivalence<\/strong>;<\/li>\n<li>the <strong>EU organic logo<\/strong> is reserved for products that comply with \u2014or are strongly aligned with\u2014 the <strong>European model of organic production<\/strong>.<\/li>\n<\/ul>\n<p>Through this, the Commission seeks to <strong>protect consumer confidence<\/strong>, provide <strong>legal certainty<\/strong> to the system and preserve the added value of the European organic seal, without renouncing smooth international trade.<br>\n[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n<\/div><\/body><\/html>","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column][vc_column_text css=\u201d\u201d] The Proposal for a Regulation COM(2025) 780 final focuses, among other aspects, on issues relating to the labelling regime for imported organic products.
