On the one hand,<br>\n<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=OJ:L_202600196&amp;qid=1770277450889\"><strong>Commission Regulation (EU) 2026\/196<\/strong><\/a> introduces significant amendments concerning food additives,<br>\nboth in relation to the Union list of authorised additives (Regulation (EC) No 1333\/2008)<br>\nand their technical specifications (Regulation (EU) No 231\/2012).<br>\nOn the other hand,<br>\n<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=OJ:L_202600189&amp;qid=1770277542151\"><strong>Commission Regulation (EU) 2026\/189<\/strong><\/a> introduces amendments and authorises a new use of shellac (E 904),<br>\nwhile also updating its technical specifications.<br>\nThese amendments result from the<strong> systematic re-evaluation programme for food additives<\/strong> carried out by the European Food Safety Authority (EFSA),<br>\nwith particular attention to<strong> foods intended for infants, young children and foods for special medical purposes (FSMP).<\/strong><\/p>\n<h2 id=\"reg-2026-196\">1. Commission Regulation (EU) 2026\/196<\/h2>\n<h3 id=\"food-additives-affected\"><strong>1.1. Food additives affected<\/strong><\/h3>\n<p>The additives concerned mainly belong to the group of <strong>hydrocolloids and modified starches<\/strong>,<br>\nwidely used by the food industry as thickeners, stabilisers or texturising agents:<\/p>\n<ul>\n<li>Carrageenans <strong>(E 407)<\/strong><\/li>\n<li>Locust bean gum<strong> (E 410)<\/strong><\/li>\n<li>Guar gum <strong>(E 412)<\/strong><\/li>\n<li>Gum arabic <strong>(E 414)<\/strong><\/li>\n<li>Xanthan gum <strong>(E 415)<\/strong><\/li>\n<li>Pectins <strong>(E 440 i and ii)<\/strong><\/li>\n<li>Sodium starch octenyl succinate <strong>(E 1450)<\/strong><\/li>\n<\/ul>\n<p>The amendments affect both <strong>conditions of use<\/strong> (food categories and maximum levels)<br>\nand <strong>technical specifications<\/strong> related to purity, definition and microbiological criteria.<\/p>\n<h3 id=\"key-regulatory-changes\"><strong>1.2. Key regulatory changes<\/strong><\/h3>\n<p>The Regulation introduces targeted restrictions and clarifications aimed at reducing exposure in vulnerable populations,<br>\nupdating additive specifications and strengthening safety requirements.<\/p>\n<h3 id=\"infant-milk-drinks\"><strong>1.3. Infant milk drinks<\/strong><\/h3>\n<p>Within category <strong>01.10 (milk-based drinks and similar products intended for young children)<\/strong>,<br>\nthe authorisation of several hydrocolloids is maintained, but a new mandatory footnote is introduced.<\/p>\n<p>When E 407, E 410, E 412, E 414, E 415 and\/or E 440 are used in combination,<br>\nthe maximum level of each additive must be reduced proportionally according to the presence of the others.<\/p>\n<p>This measure aims to limit <strong>cumulative exposure to hydrocolloids<\/strong> in products intended for infants and young children.<\/p>\n<h3 id=\"guar-gum-restrictions\"><strong>1.4. Withdrawal and restrictions on guar gum (E 412)<\/strong><\/h3>\n<p>One of the most significant changes is the <strong>progressive withdrawal of the authorisation of guar gum (E 412)<\/strong><br>\nin sensitive food categories:<\/p>\n<ul>\n<li>Infant formulae (13.1.1)<\/li>\n<li>Foods for special medical purposes intended for infants (13.1.5.1)<\/li>\n<\/ul>\n<p>For FSMP intended for infants from 4 months of age and young children (13.1.5.2),<br>\nits use is maintained only on a <strong>temporary basis<\/strong>, until <strong>27 April 2027<\/strong>,<br>\nand exclusively in liquid products containing proteins or protein hydrolysates.<\/p>\n<p>This decision is based on EFSA conclusions indicating that insufficient data are available<br>\nto demonstrate the safety of E 412 for these uses.<\/p>\n<h3 id=\"other-hydrocolloids\"><strong>1.5. Specific restrictions on other hydrocolloids<\/strong><\/h3>\n<ul>\n<li><strong>Locust bean gum (E 410):<\/strong> permitted in FSMP intended for infants only in products designed to reduce gastro-oesophageal reflux,<br>\nwith reduced maximum levels.<\/li>\n<li><strong>Pectins (E 440):<\/strong> use limited to products intended for gastrointestinal disorders, with lower maximum levels.<\/li>\n<li><strong>Sodium starch octenyl succinate (E 1450):<\/strong> maximum permitted level reduced from 20,000 mg\/kg to 10,000 mg\/kg as from<br>\n18 February 2028 due to concerns regarding infant exposure.<\/li>\n<\/ul>\n<h3 id=\"technical-specifications\"><strong>1.6. Revision of technical specifications<\/strong><\/h3>\n<p>The Regulation introduces a<strong> comprehensive revision of additive specifications,<\/strong><br>\nwith a strong focus on protecting vulnerable populations.<\/p>\n<h4><strong>Definitions<\/strong><\/h4>\n<ul>\n<li>Replacement of the terms <strong>\u201csoluble\/solution\u201d<\/strong> with <strong>\u201cdispersible\/dispersion\u201d<\/strong>, reflecting the true colloidal nature of these substances.<\/li>\n<li>Greater detail on <strong>manufacturing processes<\/strong>, particularly for vegetable gums and modified starches.<\/li>\n<\/ul>\n<h4><strong>Stricter contaminant limits<\/strong><\/h4>\n<p>Lower maximum limits are established for:<\/p>\n<ul>\n<li><strong>Lead<\/strong><\/li>\n<li><strong>Arsenic<\/strong><\/li>\n<li><strong>Mercury<\/strong><\/li>\n<li><strong>Cadmium<\/strong><\/li>\n<\/ul>\n<p>Additional limits for aluminium and protein content are introduced for certain additives,<br>\nespecially when used in foods intended for infants and young children.<\/p>\n<h4><strong>Microbiological criteria<\/strong><\/h4>\n<p>Mandatory microbiological criteria are introduced, including:<\/p>\n<ul>\n<li>Total plate count<\/li>\n<li>Yeasts and moulds<\/li>\n<li>Absence of <em>Salmonella<\/em> spp.<\/li>\n<li>Absence of <em>Cronobacter<\/em> spp. in additives intended for infant foods<\/li>\n<\/ul>\n<h3 id=\"key-dates\"><strong>1.7. Key dates and transitional periods<\/strong><\/h3>\n<ul>\n<li>Additives and foods lawfully placed on the market before 18 August 2026 may continue to be marketed until stocks are exhausted.<\/li>\n<li>For E 1450, the transitional period extends until 18 February 2028.<\/li>\n<li>Specific deadlines apply for the withdrawal of E 412, extending until April 2027.<\/li>\n<\/ul>\n<h2 id=\"reg-2026-189\">2. Commission Regulation (EU) 2026\/189<\/h2>\n<h3 id=\"shellac-use\"><strong>2.1. Newly authorised use of shellac (E 904)<\/strong><\/h3>\n<p>The Regulation authorises the use of <strong>shellac (E 904)<\/strong> as a coating agent in foods for special medical purposes,<br>\nexclusively in tablet and dragee form, under category 13.2 (excluding products under category 13.1.5).<\/p>\n<p>The maximum authorised level is <strong>46,000 mg\/kg<\/strong>, in line with its technological function as a protective coating<br>\nensuring appropriate release of active substances in the intestinal tract.<\/p>\n<h3 id=\"shellac-specifications\"><strong>2.2. Modification of technical specifications<\/strong><\/h3>\n<p>The technical specifications for <strong>shellac (E 904)<\/strong> are updated to improve clarity and safety:<\/p>\n<ul>\n<li>Removal of references to shellac with waxes.<\/li>\n<li>Redefinition as bleached shellac without waxes.<\/li>\n<li>Introduction of a maximum wax content of 0.2%.<\/li>\n<li>Adjustment of the definition to reflect the product placed on the market.<\/li>\n<\/ul>\n<h2 id=\"conclusions\">Conclusions and impact for the agri-food sector<\/h2>\n<p>These legislative changes represent a significant strengthening of the EU regulatory framework for food additives,<br>\nparticularly for products intended for infants and young children.<\/p>\n<ul>\n<li>Need to <strong>review formulations,<\/strong> especially for infant foods and FSMP.<\/li>\n<li>Updating <strong>technical specifications and quality control<\/strong> systems.<\/li>\n<li>Increased requirements for <strong>microbiological safety and contaminant control.<\/strong><\/li>\n<li>Importance of <strong>early planning<\/strong> to comply within transitional periods.<\/li>\n<\/ul>\n<p>Overall, the new regulations reinforce the preventive approach of EU food law,<br>\naligning additive authorisations and specifications with the latest scientific evidence<br>\ngenerated through EFSA\u2019s ongoing re-evaluation programme.<\/p>\n<\/article>\n<\/body><\/html>","protected":false},"excerpt":{"rendered":"<p>In this article 1.
